Yes, it can happen to you, too, because the law of India says innocent until proven guilty. But when it comes to men, society says guilty until proven innocent. It’s the reality that nobody cares about innocent men.
Even though this article is important and has solutions, 99% of you won’t read it completely. Because even men don’t care about men.
What happened to Atul Subhash? Why did he take such a big step? You must know this. So we will not waste time in repeating it; let’s come straight to the point. Atul is not alone; in India, 4237 men took their lives in 2022 due to marriage-related reasons alone. Every 9 minutes, a married man commits suicide due to fake cases. This is because of the alleged misuse of section 498a of IPC against them. This is the truth. Our system is such that no one is interested in knowing the truth.
Divorce – A Business
Here, people have made divorce a business. Divorce has become a money-making, blackmailing machine. Everybody makes money in it, including the husband-wife, the lawyers, the activists, the fake witnesses, and even the corrupt officials. In all these things, man remains only as an ATM. This is today’s tragedy.
In this article, we will not discuss the problems only. But also talk about three solutions. These are such reforms that can make our judicial system more fair. Not just for men but for women as well.

Solution #1: Pre-nups
All these marriage-related toxic situations can be avoided through prenups. You might be wondering what is prenups.
Prenups means a prenuptial contract, which defines the rights and responsibilities of both partners before marriage on paper. This means you should negotiate properly and clear the finances before marriage. This is not only for the husband but also a protective measure for the wife. So that the litigation process becomes easier later.
If in the future you get divorced for any reason. Then, what rights does the wife have? How much is the right, and what is the right of the husband? All these become fair and clear. Here, the entire transparency is maintained before the marriage. You can get a chance to balance everything from assets and liabilities to responsibilities and authorities. But there is no law in India that governs prenups.
Even today, we’ve taken the concept of Satyug, the relationship between husband and wife, which is the relationship of 7 births. So, we don’t even consider the fact that we can get divorced. So why think about prenups? In court, it happens that prenups often do not get any legal backing. That means, even if there is a prenup in India, it is like not being there. So, prenups do not even exist.
In India, prenups are illegal, but alimony is legal. This is wrong. In fact, the judge of Patiala House Court, Harish Kumar, has said that the time has come to make compulsory prenuptial agreements. Delhi court has also admitted that due to prenups, the later mental cruelty can be saved. Anyway, how many cases are pending in the court? These prenuptial agreements can effectively save the court’s time, and the couple can separate happily.
Solution #2: Gender Neutral Laws
Today, laws in India are not gender-neutral. Let me explain what it means. In both the Indian Penal Code and Indian Crime Code have defined rape in such a way that it can only be a man perpetrator and a woman victim. This is problematic because there is no provision for adult male victims.
If there had been a case like Nirbhaya, where gang rape took place, if there were a woman among the accused, then rape charges would not have been imposed on her. Plus, the possibility that men can also be raped is completely ruled out. A man will always be accused, and a woman will be the victim.
What kind of justice is this? Our law says that only the husband and his relatives can be cruel to the wife. Moreover, this is a non-bailable cognizable offence. The husband and his family can be jailed for 3 years or more. This law is so dangerous that even the Supreme Court has warned against misusing this law. With this, a wife can vent her anger on her husband.
Now, let’s talk about before marriage. If a couple is in a relationship and they become intimate before marriage. Later, for any reason, the girl can file a case against the boy, saying that he made a false promise of marriage and then did not marry her. But what if the opposite happens? If the girl made a promise of marriage and didn’t get married. Then, does the boy have any legal remedy? No. What do you think? Is this fair?
Look, no one should abuse each other. There should be no abusive language. There is no gender issue in this. But if a boy abuses a girl, then he will be punished. If a girl abuses a boy, then it doesn’t matter. LOL. What kind of justice is this? There is a provision for the emotional abuse of women and girls. But nothing for boys. It means that our justice system also believes that boys don’t have emotions. Boys are either machines or ATMs.
Credit where it’s due. In the Indian Constitution, the definition of gender has been broadened, including transgender. But this is not sufficient. The Law Commission of India suggested modifying rape laws on 25th March 2000, where they advised to make gender-neutral language. But no one listened to this suggestion. Understand that having gender-neutral laws doesn’t undermine the atrocities against women. It just argues that a male and a female should be seen with the same eyes. When we talk about gender equality, then these points are essential, too.
In India, there are two parallel realities. One is that there are many houses where women are abused and harassed. Even today, they’re harassed for dowry. This is a reality that is seen in many homes. Another fact is that many women file fake cases on men and destroy their homes and families. There are many such documented cases. Both of these simultaneously exist in India, and they are very restrictive and myopic to assume the other side doesn’t exist.
Solution #3: False Allegations are Punished
The court says that giving fake evidence is a crime. But still, fake cases do exist. People are trapped in counterfeit allegations. And how many people’s careers have ended because of this? An example of this will not be set until those who file false cases are punished. And injustice will continue to increase in society. People will lose faith in the justice system.
Today, there is no men’s rights tribunal in India where there is redressal for such cases. What about those who don’t have the money to go to court or hire a good lawyer or resources? No one thinks about this. Even Atul had to leave his job 40 times and go to court in another city. Even his family was included in the accusation of harassment. Today, there is a need for change in society. Otherwise, nothing can be done.

At the end of this article, I want to remind you of an old case. A few years ago, there was a case in Delhi, i.e., Jasleen Kaur VS. Sarvejit Singh. Where a girl took a photo of a boy sitting on a bike and uploaded it on social media. Over the night, Sarvejit’s name became Delhi’s monster. Before the court found him guilty, the whole world had declared him guilty. He lost his job. That same year, his father was so stressed that he had a heart attack. His mother went into depression. Jasleen Kaur didn’t appear in court for 10 days when the case went to court. She had gone to study in another country.
After 3 years of the case, the court finally declared Sarvejit not guilty. But what about the mental harassment, the insult, and the humiliation? This situation taught me that men do not always make mistakes.
Yes, there are good men, and there are evil men. But there are good women and bad women, too. And it makes a difference for me to convey this vital message to you.
